Understand Enabling Point Limits
Let's talk a little about Article 261, which deals with the penalty of suspension of driving rights. Look:

Art. 261. The penalty of suspension of the right to drive shall be imposed in the following cases:

I - whenever the violator reaches the score of 20 (twenty) points, within 12 (twelve) months, according to the score provided for in art. 259;

II - for breach of the rules established in this Code, whose offenses specifically provide for the penalty of suspension of the right to drive.

Of course impossible, no? According to Article 261 (I), therefore, if in a 12-month period you accumulate 20 or more qualifying points, you have suspended the right to drive.



CNH Score: How It Works

The count just explained is not renewed on January 1st, and the driver may accumulate below the 20-point limit by December 31st.

Whenever you commit an infraction, your points will be added to those that you accumulated in the previous 12 months, no matter what time of year you are.

For example, if you committed an average infraction in April (04 points), a serious infringement (05 points) last January, another average (04 points) in September of the previous year and a very serious one (07 points) in May, exactly 20 points in the last 12 months, resulting in suspension of CNH.
To make it easier to see, imagine that in a year you commit the following infractions, consistent with the example just given:

Parked in a prohibited place (article 181, item XVII, average infraction, 4 points)
It has moved at a speed between 20% and 50% above the maximum allowed (Article 218, Item II, Serious Infringement, 5 points);
Was caught throwing something out of the vehicle (article 172, average infringement, 4 points);
Drove vehicle handling the cell phone (article 252, sole paragraph, very serious infringement, 7 points).
If a driver is very reckless and unlucky, he or she may break maximum points in a single approach.

Doubt? So imagine that on a highway, before a Federal Highway Police (PRF) post, you make a overpass on a bridge.

According to item III of article 203 of the CTB, this is a very serious violation and seven points. A very attentive policeman observes the maneuver and orders you to pull over to drive it.

In the same approach, he sees that one of the passengers in the back seat is without his seat belt. According to Article 167, serious infringement, five points.

The same policeman also sues you for the burnt-out lamp in the car. According to article 230, there is an average infraction and four points in the qualification.

Do not lose count, we already have 16 points adding the three infractions. But there is more.

Upon verifying his CNH, the policeman verifies that he has been past due for more than 30 days. This is another very serious violation, as stated in article 162, item V of the Traffic Code.

With these seven points, we reach 23, three more than the limit. Resulting in the suspension of the right to drive.

Of course, it is unlikely to receive as many qualifying points in a single approach. But imagine the same situation without the fines for the belt and burnt out lamp.

If the only infractions are forbidden overtaking and overdue, a more likely scenario, you will already have 14 points - a very serious infraction over 12 months and the wallet will be suspended.

The Brazilian Traffic Code (CTB) is the law that, among other things, establishes infractions and penalties based on rules of conduct, aiming at safer traffic.

It is your article 259 that talks about the points attributed to traffic violations. Look:

Art. 259. At each offense committed, the following number of points are counted:

I - very serious - seven points;

II - serious - five points;

III - average - four points;

IV - light - three points.
