বাংলাদেশের সংবিধান - সম্পূর্ণ

গণপ্রজাতন্ত্রী বাংলাদেশের সংবিধান স্বাধীন ও সার্বভৌম বাংলাদেশ রাষ্ট্রের সর্বোচ্চ আইন। এটি একটি লিখিত দলিল। ১৯৭২ খ্রিষ্টাব্দের ৪ঠা নভেম্বর তারিখে বাংলাদেশের জাতীয় সংসদে এই সংবিধান গৃহীত হয় এবং একই বছরের ১৬ই ডিসেম্বর অর্থাৎ বাংলাদেশের বিজয় দিবসের প্রথম বার্ষিকী হতে এটি কার্যকর হয়। এটি বাংলা ও ইংরেজি উভয় ভাষায় বিদ্যমান। তবে ইংরেজি ও বাংলার মধ্যে অর্থগত বিরোধ দৃশ্যমান হলে বাংলা রূপ অনুসরণীয় হবে।[১]

১০ই এপ্রিল ২০১৮ সালের সপ্তদশ সংশোধনী সহ বাংলাদেশের সংবিধান সর্বমোট ১৭ বার সংশোধিত হয়েছে। এই সংবিধান সংশোধনের জন্য সংবিধানের ১৪২নং অনুচ্ছেদ অনুযায়ী জাতীয় সংসদের সদস্যদের মোট সংখ্যার দুই তৃতীয়াংশ সদস্যের ভোটের প্রয়োজন হয়। তবে পঞ্চম সংশোধনী , সপ্তম সংশোধনী , ত্রয়োদশ সংশোধনী ও ষোড়শ সংশোধনী বাতিলের আদেশে বাংলাদেশ সুপ্রীম কোর্ট রায় দিয়েছে যে, সংবিধানের মূল কাঠামো পরিবর্তন হয়ে যায় এরূপ কোনো সংশোধনী এতে আনা যাবে না; আনা হলে তা হবে এখতিয়ার বহির্ভূত।[২]

বাংলাদেশের সংবিধান কেবল বাংলাদেশের সর্বোচ্চ আইনই নয়;- সংবিধানে বাংলাদেশ নামক রাষ্ট্রের মূল চরিত্র বর্ণিত রয়েছে। এতে বাংলাদেশের ভৌগোলিক সীমারেখা বিধৃত আছে। দেশটি হবে প্রজাতান্ত্রিক, গণতন্ত্র হবে এদেশের প্রশাসনিক ভিত্তি, জনগণ হবে সকল ক্ষমতার উৎস এবং বিচার বিভাগ হবে স্বাধীন। জনগণ সকল ক্ষমতার উৎস হলেও দেশ আইন দ্বারা পরিচালিত হবে। সংবিধানে জাতীয়তাবাদ, সমাজতন্ত্র, গণতন্ত্র ও ধর্মনিরপেক্ষতা -কে রাষ্ট্র পরিচালনার মূলনীতি হিসেবে গ্রহণ করা হয়েছে।


The Constitution of Bangladesh (Bengali: বাংলাদেশের সংবিধান — Bangladesher Sambidhāna), officially the Constitution of the People's Republic of Bangladesh (Bengali: গণপ্রজাতন্ত্রী বাংলাদেশের সংবিধান — Gaṇaprajātantrī Bangladesher Sambidhāna) is the supreme law of Bangladesh. The document provides the framework that demarcates the Bangladeshi republic with a unitary, parliamentary democracy, that enshrines fundamental human rights and freedoms, an independent judiciary, democratic local government and a national bureaucracy.

The four fundamental principles of the Constitution are nationalism,[1] socialism,[2] democracy[3] and secularism.[4] The Constitution endeavors to create a socialist society in which the rule of law, fundamental human rights and freedom, equality and justice, political, economic and social, is secured for all its citizens. It commits Bangladesh to “contribute to international peace and co-operation in keeping with the progressive aspirations of mankind”.

It invokes constitutional supremacy, as opposed to legislative supremacy since it was created by a constituent assembly not Parliament and was adopted by the people of Bangladesh in its preamble. Parliament cannot quash parts of the Constitution.

Judicial precedent is enshrined in Bangladesh's Constitution under Article 111which makes Bangladesh an integral part of the common law world. Judicial review is also supported by the Constitution.

It was adopted by the Constituent Assembly of Bangladesh on 4 November 1972 and became effective on 16 December 1972. The Constitution replaced the Proclamation of Independence as the country's fundamental instrument of government. The Constitution became effective on Bangladesh's Victory Day, precisely one year after the signing of the Instrument of Surrender.
